Certain individuals may qualify for lawful permanent resident status based upon U.S. employment.

Form I-140 is used to apply for permanent residence based on employment in the U.S.  An I-140 petition is also called an Immigrant Petition for Alien Worker. This type of visa is difficult to get, but it allows qualifying employees in the U.S. to apply for a permanent residency visa also known as a “Green Card.”

What are the Requirements for an Employment-Based Permanent Residence Petition Using Form 1-140?

There are many requirements to qualify for employment-based permanent resident status. First you must fall within one of the following categories. This list is not exhaustive, but these are the most common categories:

Persons with extraordinary ability in athletics, education, business, sciences or the arts;

Outstanding professors and researchers in a specific academic area;

Multinational executives or managers of a U.S. company or foreign affiliate who have been employed abroad for at least one year in the past three years;

Professionals with an advanced degree or who because of their exceptional ability in the sciences, arts or business will benefit the U.S and whose services are sought by a U.S. employer;

Professionals with a bachelor’s degree or its equivalent.



How Long is the Visa Valid?

This is a permanent residence visa and is valid indefinitely.  This visa will allow you to apply for U.S. citizenship.



Are Dependents Eligible for Permanent Residence?

Yes. Your spouse and children may qualify for permanent resident status based upon the approval of a Form I-140 petition submitted on your behalf. When approval is received you and your dependents may apply for permanent residence.
